Remember that header you made with the redhaired girl on the book? The one I bought for my website? The one that looks like this: http://blogs.publishersweekly.com/blogs/beyondherbook/?p=3534

Do I have the right to bitch that it's being used for something else? I thought it was all mine.

Your header is all yours, but the image is stock photo. If they had cut a part of your header you would have a beef.

Did they? I'm not saying they didn't, but it doesn't look as if it was.

The header with a name, editing of the image, etc would be a violation of YOUR copyright, though.

I can't tell from that small image, but it looks like they used the same stock photo, NOT a clipping of the finished header.

Does that make sense? It's like buying a romance cover-- you can find other covers with the same stock photo, but if they are using the edits to it and the title, etc-- no, that's not allowed.

I think I got it. I was under the assumption the entire thing was mine. I have my business cards and promo items all with that same image. I can't get into any kind of copyright infringement issues, can I?

No, absolutely NOT. I purchased the stock image and created the template. You own the rights to reproduce it. That's why it has to be purchased.

I kind of don't blame you for being pissed. I don't use images that are everywhere... and I have a suspicion somebody saw your site, liked it, and checked Istock and Dreamstime because I use them.

I've never seen it used anywhere else... that's why I bought it to start with. :/

Yeah, great. Sincerest form of flattery. So long as I'm not in trouble, I'll deal. It just sucks because it's that romance trading card site that's using it: http://romancetradingcards.com/

so I'm sure it's getting a lot of hits.

Kinda makes no sense, since the whole point of the trading cards has nothing what-so-ever to do with that image.

???
